These Secure Logistics XS-ID app terms of use (“Terms”) describe the general terms and conditions for your use of the Secure Logistics XS-ID app (“App”) and all related products and services (collectively “Services”). These Terms are legally binding between you (“you”) and Secure Logistics B.V., Waalhaven Zuidzijde 19 PortCity II, 3089 JH Rotterdam (“Secure Logistics”).

Acceptance of these terms

You acknowledge that you have read these terms and agree to all conditions. By accessing and using the app and Services, you agree to be bound by these terms. If you do not agree to these terms, you are not authorized to access or use the app and services.

Accounts

If you create an account in the app, you are responsible for maintaining the security of your account and for all activities that occur under the account. We may review new accounts before you are able to sign in and use the services. Providing false contact information may result in the termination of your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

 

We are not liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

 

We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of these terms or that your conduct or content could harm our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re register for our services. We may block your email address to prevent further registration.

Access with QR code

You can order various products via the app. With an account and login, you can for example obtain OneTime XS for the relevant location. If access is not paid for by the location, you can pay using the applicable payment system. You pay directly at the time of your order. After that, you will receive a QR code via the app for access, functioning as an access pass.

Personal data

Your provision of personal information through the App and Services is governed by our Privacy Statement.

 

Specifically for the app, the following points apply in addition to the Privacy Statement:

 

When using the app, we may collect device information related to your interactions with us, such as geo location, browser type and operating system, Internet Protocol (IP) address (a unique number that identifies your internet access), a specific session, and the date and time of access. We store your personal data in a secure cloud environment. We do not retain your data longer than necessary. When you delete your account, we delete your personal data.

When using the app, we may process payment information, such as payment method (for example credit card or iDeal/Wero) and payment details (such as account number, account holder, payment amount, time of transactions) so that we can process payments and include them in our financial administration to comply with regulations of the Dutch Tax Authorities. We may process this data because we need it to perform our contract with you and to comply with the rules of the Dutch Tax Authorities.

The legal bases are: the performance of an agreement with you for the use of the app and legitimate interest. An appeal to legitimate interest requires a balancing of interests between the legitimate interest of Secure Logistics and your interests, rights and freedoms. In this context, it is relevant that we pseudonymize and aggregate where possible. In addition, Secure Logistics continuously monitors its quality. Furthermore, only a limited number of employees have access to your personal data and Secure Logistics has properly secured your personal data.

Prohibited use

In addition to other terms as set forth in these terms, you are prohibited from using the App and Services: (a) for any unlawful purpose such as unauthorized access; (b) to infringe intellectual property rights; (c) to harass or discriminate against others; (d) to provide false or misleading information; (e) to interfere with or circumvent the security features of the App and Services. We reserve the right to terminate your use of the app and Services for violation of the prohibited use.

Intellectual property rights

Intellectual property rights are current and future rights relating to copyrights and related rights, trademarks, designs, patents, inventions and goodwill. These Terms do not transfer any intellectual property of Secure Logistics or third parties to you, and all rights remain with Secure Logistics. Your use of the app and services does not grant you any right or license to reproduce or otherwise use trademarks of Secure Logistics or third parties.

Limited warranty and limitation of liability

To the extent permitted by applicable law, we provide the app and services “as is” and “with all faults”. Any use of the app and services is at your own risk and responsibility. We provide no warranties, including warranties of fitness for a particular purpose and non infringement of intellectual property rights. Unless expressly agreed otherwise in writing, we do not guarantee that the App and Services will be accessible at all times and without interruptions or malfunctions. Disruptions in the App and Services may occur due to failures in internet or telephone connections or due to viruses or malfunctions. We are in no way liable or obligated to compensate you for any damage arising from or resulting from the (temporary) unavailability of the App and Services or from malfunctions or outages of the App and Services. We do not guarantee that the app and services made available to you will remain available, error free, or operate without interruptions.

Dispute resolution

Dutch law applies. Jurisdiction lies with the court in Rotterdam.

Changes

We reserve the right to modify these Terms relating to the app and services at any time. When we do so, we will revise the updated date at the bottom of this page. We may also notify you in other ways, for example via the contact details you have provided.

 

An updated version of these terms will take effect immediately upon posting the revised terms, unless otherwise indicated. Your continued use of the app and Services after the effective date of the revised Terms constitutes your acceptance of those changes.
